Important legislative changes in the construction sector in 2024

Changes and innovations are constantly appearing in the legislation regulating the construction industry. The most notable of them were told by a specialist from the Far Eastern Design Center:

- This year, an important change is coming for developers who are implementing shared-equity construction projects under Federal Law 214-FZ.
From July 1, 2024, they will be required to apply information models of capital construction facilities. When constructing individual housing construction facilities, this norm will become effective from January 1, 2025.
If the developer does not apply information modeling technologies (TIM), he will not be able to pass the state examination of the results of engineering surveys and design documentation, and without this examination it is impossible to erect most construction projects.
Such legislative changes are not accidental - the use of TIM is of great importance for improving the efficiency of the construction complex: the use of these technologies increases the accuracy of decisions at all stages of construction, improves the quality of work, reduces the construction time of construction facilities, makes interaction between the customer and contractors more transparent.
Another notable innovation of this year's legislation is the introduction of monitoring of facilities with budget financing from January 1, 2024 (this applies to projects that are implemented within the framework of state programs and national projects and are included in the comprehensive state program "Construction").
The monitoring system covers various stages of the project implementation and should include a number of mandatory control points, including: obtaining a positive conclusion from the state expert examination; providing a land plot to the customer; obtaining a construction permit; concluding a contract for construction and installation works or the purchase of an object, etc.
The purpose of implementing such a monitoring system is to reduce risks during the construction of socially significant facilities, to be able to monitor the implementation of the project in real time and make the necessary management decisions in a timely manner.
Another important change is the reduction of the exhaustive list of documents, information and approvals for the construction of a capital construction facility (on December 30, 2023, the corresponding decree of the Government of the Russian Federation was published).
89 items have been excluded from the list, mainly those information and documents that public authorities have the opportunity to obtain within the framework of interdepartmental interaction.
In general, there is a constant tendency to reduce the number of documents and approvals required by the developer, the technical customer for the construction of a capital construction facility, which, in turn, helps to shorten the investment and construction cycle and increases the attractiveness of the construction industry for investors.
